INTRODUCTION AND ACCEPTANCE

Welcome to RKP Finance Private Limited (hereinafter referred to as "Company", "We", "Us", or "Our"). These Terms and Conditions govern your access to and use of our website (https://rkpfinance.com) and our financial services.

By accessing this website, downloading our mobile application, or applying for any financial product, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue the use of our website and services.


ELIGIBILITY CRITERIA

To use our services or apply for a loan, you must represent and warrant that:

  • You are a citizen of India and reside in India.
  • You are at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872.
  • You have not been previously suspended or banned from using our services.
  • All information provided by you is truthful, accurate, and complete.


SERVICES OFFERED

RKP Finance provides various financial products, including but not limited to:

  • Commercial Vehicle Loans
  • MSME / SME Loans
  • Mortgage Loans
  • Personal Finance (as per company policy)

All loan sanctions are at the sole discretion of the Company and subject to the submission of required documents, credit checks, and internal policy guidelines.


LOAN APPLICATION AND PROCESSING

A. Application

By submitting a loan application, you authorize the Company to verify your identity, employment, and income details. You agree to submit valid Know Your Customer (KYC) documents as per RBI guidelines.

B. Credit Bureau Check

You expressly authorize RKP Finance to access your credit information from Credit Information Companies (CICs) such as CIBIL, Equifax, Experian, or CRIF High Mark. You understand that your credit score will influence the approval of your loan and the interest rate offered.

C. Rejection

RKP Finance reserves the right to reject any loan application without assigning any specific reason. The processing fee (if collected) may or may not be refundable, depending on the stage of the application and specific product terms.


INTEREST, FEES, AND CHARGES

  • Interest Rate: The interest rate applicable to your loan will be communicated to you in the Sanction Letter. It may be fixed or floating, depending on the agreement.
  • Processing Fees: A non-refundable processing fee may be charged for appraising your application.
  • Penal Charges: In case of delayed payments or bouncing of cheques/NACH mandates, penal interest and bounce charges will be applicable as per the loan agreement.
  • Prepayment Charges: Foreclosure or part-payment charges may apply as per the Company’s schedule of charges.


REPAYMENT AND DEFAULT

You agree to repay the loan amount along with interest in the form of Equated Monthly Installments (EMIs) on or before the due date mentioned in the agreement.

Events of Default: The following shall constitute an event of default:

  • Failure to pay any EMI on the due date.
  • Submission of false or misleading information or documents.
  • Use of loan funds for illegal or prohibited purposes.
  • Bankruptcy or insolvency of the borrower.

In the event of default, the Company reserves the right to recall the entire outstanding loan amount immediately and initiate legal proceedings for recovery.


CONSENT TO CONTACT (DND WAIVER)

By registering your contact details on our website or showing interest in our products, you give your free and valid consent to RKP Finance and its representatives to contact you via:

  • Phone Calls
  • SMS / Text Messages
  • WhatsApp
  • Email

This consent overrides your registration with the National Do Not Call Registry (NDNC) or DND. You agree that such communication regarding your loan application or our products shall not be considered as unsolicited commercial communication.


INTELLECTUAL PROPERTY RIGHTS

All content on this website, including logos, trademarks, text, graphics, images, software, and layouts, is the exclusive property of RKP Finance Private Limited. You are prohibited from copying, distributing, modifying, or using any content without our prior written permission.


LIMITATION OF LIABILITY

The Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of:

  • Your use or inability to use the website.
  • Any errors, mistakes, or inaccuracies in the content.
  • Unauthorized access to our servers or your personal information.
  • Any interruption or cessation of transmission to or from our website.


INDEMNITY

You agree to indemnify and hold harmless RKP Finance, its directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your violation of these Terms, your misuse of the website, or your violation of any third-party rights.


GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the laws of India.

Jurisdiction: Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan.

Arbitration: The Company may, at its discretion, refer any dispute to a sole arbitrator appointed by the Company, with the seat of arbitration being Jaipur.


MODIFICATIONS TO TERMS

RKP Finance reserves the right to modify, amend, or update these Terms and Conditions at any time without prior notice. The updated terms will be effective immediately upon posting on this page. Your continued use of the website constitutes acceptance of the modified terms.
